Terms of Use

These Terms of Use (“Terms”) apply to the Porkfolio app for iPhone and Apple Watch, including its widgets, complications, and Siri and Shortcuts actions (together, “Porkfolio” or the “app”), and to the optional Pork Prime upgrade. Porkfolio is provided by SkinSoftware GmbH, Alfred-Comte-Strasse 1, 8953 Dietikon, Switzerland (“SkinSoftware”, “we”, “us”, or “our”).

By downloading or using Porkfolio, you agree to these Terms. If you do not agree, please do not use the app.

Apple’s Standard EULA

Porkfolio is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms supplement the Standard EULA with information specific to Porkfolio. If these Terms conflict with the Standard EULA regarding your licence to use the app, the Standard EULA prevails.

You acknowledge that these Terms are between you and SkinSoftware only, not Apple, and that SkinSoftware, not Apple, is solely responsible for Porkfolio and its content, to the extent described in the Standard EULA.

What Porkfolio is

Porkfolio is a photo food diary. You log meals with a photo, a line of text, or both, and rate each meal on the Pigginess scale — a personal impression of how a meal felt, shown with pig symbols. Porkfolio also lets you track water, mood, and appetite, set meal reminders, follow your progress, take on challenges on your own or with friends, and export a printable PDF.

Porkfolio is intended for personal, non-commercial use. If you are under the age of majority where you live, you may use Porkfolio only with the involvement of a parent or legal guardian, who is responsible for purchases made on your device.

Not medical advice

Porkfolio is a tool for personal reflection. It is not a medical device, and it does not provide medical, nutritional, dietary, or psychological advice, diagnosis, or treatment.

• Pigginess is your own impression of a meal. It is not a calorie count, a nutrition score, or an assessment of your health or your body.
• Trends, recaps, challenges, and information read from Apple Health are shown for your own reflection. They may be incomplete or inaccurate and must not be relied on for health decisions.
• Suggestions generated with Apple Intelligence, such as a draft meal description or a suggested Pigginess level, are automatically generated and may be wrong. Review them before saving.

Always seek the advice of a doctor, dietitian, or other qualified professional about your health, diet, or eating habits. If you are struggling with food, eating, or your body image, please reach out to a professional or a local support service. In an emergency, contact your local emergency number.

Free features and Pork Prime

Porkfolio’s everyday diary is free. Pork Prime is an optional paid upgrade that unlocks additional features, such as PDF export, Trends and recaps, widgets, Apple Health, the Apple Watch app, and the private photo gallery. The features included in the free version and in Pork Prime are described in the app and on porkfoliodiary.app, and may change over time as described in Changes to the app.

Pork Prime is offered as:

• Monthly subscription — an auto-renewable subscription billed every month;
• Yearly subscription — an auto-renewable subscription billed every year, which may include a free trial for eligible users; and
• Lifetime — a one-time, non-consumable purchase with no recurring charges.

Prices, and any offers or free trials, are shown in the app before you buy and may vary by country or region. All purchases are made through Apple’s App Store and are subject to Apple’s Media Services Terms and Conditions.

Subscriptions, free trials, and cancellation

• Payment. Payment is charged to your Apple Account when you confirm the purchase.
• Automatic renewal. Subscriptions renew automatically for the same period and at the then-current price unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within the 24 hours before the current period ends.
• Managing and cancelling. You can manage or cancel your subscription at any time in your Apple Account settings on your device (Settings › your name › Subscriptions) or in the App Store. Cancellation takes effect at the end of the current billing period; you keep Pork Prime until then. Deleting the app does not cancel a subscription.
• Free trial. If a free trial is offered, it converts automatically into a paid yearly subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription. Eligibility for a free trial is determined by Apple.
• Price changes. If the price of a subscription changes, Apple will inform you in advance and, where required, ask for your consent before the new price applies.
• Restoring purchases. You can restore Pork Prime on another device signed in to the same Apple Account using “Restore Purchases” in the app.

Refunds

Purchases are processed by Apple, and SkinSoftware cannot issue refunds directly. You can request a refund from Apple at reportaproblem.apple.com. Refund requests are handled by Apple under its policies and any consumer rights that apply to you.

Lifetime purchase

A lifetime purchase unlocks Pork Prime without recurring charges for as long as we make Porkfolio and Pork Prime available on the App Store for your device. It is linked to your Apple Account and is not transferable. “Lifetime” refers to the life of the product, not of any person or device.

Your content

The meals, photos, notes, ratings, and other information you add to Porkfolio (“your content”) belong to you. Porkfolio stores your content locally on your device; SkinSoftware does not host it and cannot access, recover, or restore it. How we handle information is explained in our Privacy Policy.

• You are responsible for keeping your device and its backups secure and for backing up your content. The private photo gallery is never backed up and cannot be recovered if you delete the app, reset or lose your device, or turn off your device passcode.
• Widgets and complications can show diary information on your Lock Screen and watch face.
• When you export a PDF, share card, or meal image, or share content through the system share sheet, you decide who receives it and are responsible for that choice.
• If you start or join a challenge with friends, the name you enter and your challenge progress are visible to everyone in that challenge. Anyone with a valid invite link can join, so share invites only with people you trust, and use a name you are comfortable sharing.
• Only add photos and content you have the right to use.

Acceptable use

You agree not to misuse Porkfolio, including by attempting to copy, modify, reverse engineer, or circumvent the app’s purchase or security features except as permitted by law or the Standard EULA, by using challenge names or invites to harass, mislead, or impersonate others, or by using the app in violation of applicable law.

Apple services and device features

Some features depend on Apple services and system features, such as Apple Health, Siri, Shortcuts, Apple Intelligence, widgets, Apple Watch, notifications, and the App Store. Their availability depends on your device, operating system version, region, language, and settings, and they are provided by Apple under Apple’s own terms. For example, Apple Intelligence features require a supported device, the Apple Watch app requires a paired Apple Watch with a supported version of watchOS, and challenges with friends require iCloud.

Changes to the app

We continuously improve Porkfolio and may add, change, or remove features, including features in the free version and in Pork Prime, and may stop supporting older devices or operating system versions. If we remove a significant Pork Prime feature, we will make reasonable efforts to inform you in advance, for example in the app or in the App Store release notes. Nothing in these Terms limits any rights you have under applicable consumer law.

Intellectual property

Porkfolio, Pork Prime, the pig artwork, the app’s design, and all related names, logos, and content (other than your content) are owned by SkinSoftware or its licensors and are protected by intellectual-property laws. Apple, Apple Watch, iPhone, Siri, and App Store are trademarks of Apple Inc. These Terms do not grant you any right to use our trademarks.

Disclaimers

Porkfolio is provided “as is” and “as available”. To the extent permitted by law, we do not warrant that the app will be uninterrupted, error-free, or suitable for a particular purpose, or that information shown in the app — including trends, recaps, and Apple Intelligence suggestions — is accurate or complete. Any statutory warranties that cannot be excluded by law remain unaffected and are governed by the Standard EULA.

Limitation of liability

To the extent permitted by applicable law, SkinSoftware is not liable for indirect or consequential damages, loss of data, or loss of content, including loss of content stored only on your device. Our total liability relating to Porkfolio is limited to the amount you paid for Pork Prime in the twelve months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for intent or gross negligence, for death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection law in your country of residence.

Ending your use

You may stop using Porkfolio at any time by deleting the app. If you have a subscription, remember to cancel it in your Apple Account settings, because deleting the app does not cancel it. We may suspend or end your licence to use Porkfolio if you seriously breach these Terms, as described in the Standard EULA.

Changes to these Terms

We may update these Terms, for example when we add features or when the law changes. We will publish the updated Terms on this page and revise the effective date above. If a change materially affects you, we will make reasonable efforts to inform you in advance, for example in the app. If you continue to use Porkfolio after the updated Terms take effect, you accept them; if you do not agree, you may stop using the app and cancel any subscription.

Governing law and disputes

These Terms and any dispute arising from or relating to them are governed by the laws of Switzerland, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). The courts of the canton of Zurich, Switzerland, have exclusive jurisdiction, subject to any mandatory right of appeal to the Swiss Federal Supreme Court.

If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring a claim in the courts of that country where the law allows. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
